Four suspects, including a mother, her two children and a police officer, are set to face murder charges over the death of Dr Victoria Nthunya Mutiso.
The four were presented separately before the High Court in Nairobi, where the prosecution formally informed them of the murder charge on behalf of the Director of Public Prosecutions.
However, they did not take plea after the court directed that they first undergo psychiatric assessments.
Rose Mbithe Mulwa, also known as Rose Mbithe Ndetet, her children Chris Mulwa and Angela Mulwa, and police officer Elijah Kibelion are accused of involvement in Dr Mutiso’s death.
According to the charge sheet, Rose, Chris and Angela allegedly committed the offence jointly with other persons who have not been presented before the court.
The prosecution alleges that Dr Mutiso was murdered on July 29, 2026, at about 9.30am along Mawensi Road in Kilimani, Nairobi County.
Justice Kanyi Kimondo directed that the suspects should not be called upon to plead to the murder charge until their psychiatric assessments are completed at Mbagathi Hospital.
“The suspects will not plead to the charges until they undergo psychiatric assessment.” he ordered.
The case will return to court on September 23, 2026, when the suspects are expected to take plea before Justice Alexander Muteti.
The court also declined a request by the defence to have Rose and Angela held at a police station as efforts continued to resolve a related civil dispute involving contested property.
The two were instead ordered to be remanded at Lang’ata Women’s Prison.
Chris Mulwa and Kibelion were directed to remain at Nairobi Remand Prison pending further directions.
The court further ordered that a pro bono advocate be appointed to represent Kibelion during the criminal proceedings.
The prosecution has preferred a murder charge under Section 203 as read with Section 204 of the Penal Code.
The four suspects will remain in custody as they await psychiatric assessment and their next court appearance.
