Director of Public Prosecution (DPP) Noordin Haji has asked the High Court in Nairobi to cancel bail awarded to Joseph Irungu alias ‘Jowie’ and have him returned to the Kamiti Maximum Prison for violation of the release terms.
The DPP wants the bond granted to Jowie to be revoked for a number of alleged breaches which include being involved in a physical fight at a popular club in Nairobi’s Lang’ata Road area.
According to the affidavit, filed in court, the accused allegedly assaulted a man only identified as Rogers Okuga during a night out.
Okuga, who reported the matter to Lang’ata police station, accused him of assaulting him while having drinks at the popular drinking joint.
The investigating officer added that Jowie lied about his official residence, stating that he did not live with his mother in Nakuru County as he had told the court before he was released on bail.
In addition, the DPP stated that the administrator in the farm where Irungu was to live and assist with work had not forwarded monthly reports to the Deputy Registrar of the high court about his attendance.
“That the accused has not only gone against the honourable court’s finding on the location or place of abode when honourable judge granted the bail terms by being away from Nakuru County,” the application read in part.
Instead, the officer established that Jacque Maribe’s former lover has been living in Nairobi and working in a private security company.
He is also reported to frequent the Lang’ata Road club where most of the witnesses in his murder case frequent.
“He continues to move and reside within the Langata area being the secondary crime scene and the locality of the potential witnesses who have and are yet to testify,” the application stated.
Jowie’s lawyer, David Ayuo, countered the bar fight incident stating that Okuga had withdrawn the matter from the police station upon reaching an agreement with the accused.
While admitting to the fact that his client worked in a private security company, Ayuo defended the move by Jowie arguing that he was looking for means to cater for his child and ageing parents.
Jowie stated that he was too drunk to remember the events that unfolded in the club. In his statement, he noted that he only remembered being assisted into a taxi by his friend.
The taxi then took him to a sibling’s house after which he went to Langata Hospital to receive treatment as he had a deep cut.
In addition, the DPP accused Maribe’s former paramour of discussing the merits of the murder case while on YouTube interviews contrary to the directives issued by Justice James Wakiaga.
The High Court is expected to make a ruling on whether it will cancel the bond granted to Jowie on Tuesday, September 28.
Jowie Irungu is out on bond in the case in which he is a suspect in the murder of businesswoman Monica Kimani alongside former TV reporter Jackie Maribe.
