Court orders doctor to take care of man’s child up to age 18 after failed vasectomy

In an unusual court ruling, Dr. Diego Naranjo from Medellin, Colombia has been ordered to financially support a child until they reach the age of 18. The child was conceived despite the man undergoing a vasectomy, which was performed by Dr. Naranjo in 2012. The court found the doctor liable for the failed procedure, resulting in the unplanned pregnancy and subsequent financial and emotional challenges faced by the parents.

Following the vasectomy, it was discovered that the procedure had not been successful through subsequent sperm tests. The court determined that due to this unexpected outcome, the patient was advised against further contraceptive methods to prevent pregnancy. The court acknowledged the impact on the parents' life plans, particularly considering the father's current health issues, which prevent him from working and exacerbate their financial difficulties.

As a result of the court ruling, Dr. Naranjo is obligated to compensate the family with 80 times the current minimum wage, amounting to 92 million pesos ($20,300), for moral damages. Additionally, he must cover 60 million pesos ($13,200) in legal fees and provide 143 million pesos ($31,500) to support the family in raising their unplanned child.

Interestingly, the child in question is already 10 years old, which means the doctor will have some respite after eight more years. The child's father suffers from severe bilateral hearing loss, a debilitating condition that prevents him from working. He experiences frequent dizziness and vomiting and relies on a hearing aid for proper hearing. Due to his health condition, he is unable to earn income to support the upbringing of his daughter.
