The family of a Grade 8 pupil at Joy Gardens Primary in Tena-Umoja, Nairobi, who died under mysterious circumstances after allegedly falling from the seventh floor, has raised concerns over the autopsy report, suspecting foul play.
According to reports, the family has contested the post-mortem results, alleging that the defendants' lawyers had compromised them.
The family strongly maintains that the circumstances surrounding the minor's death do not align with the findings of the autopsy report. They emphasized the absence of blood at the scene, despite the report indicating a fall from the seventh floor.
"We objected from the word go…there was no blood at the scene. I don't know what is happening, but I pray that justice for my son is given. I don't want money," expressed the father of the deceased.
The mother, while pledging to pursue justice for her son, accused the defendant's lawyer of engaging a pathologist without her knowledge, resulting in conflicting outcomes.
"This thing is not ending here; we are going to seek justice. The DCI said it was not consistent, but here they are saying it is consistent. How do you fall and go into a coma…The results were compromised," she asserted.
City Lawyer Danstan Omari, representing the school, reiterated the innocence of his clients, citing the postmortem results indicating that the minor's death resulted from a fall from a height.
"Three pathologists, government, family, and school representative have agreed bones were broken, front part broken, rib, spinal cord, and cause of death is a fall from height, which exonerates our client," stated Omari.
He assured that the school would extend support to the grieving family over the tragic loss of their Grade 8 pupil.
"We are heading to court in 10 minutes to request the court to release our client, having been exonerated," Omari added.
The school management informed the family on Friday that their 13-year-old son had fallen from the seventh floor of the school building around 6 pm on Friday.
Detectives from the Directorate of Criminal Investigations (DCI) visited the school to retrieve CCTV footage and investigate the circumstances leading to the boy's death.
In light of the incident, two directors and three other individuals were arraigned on Monday, with the prosecution seeking 21 days to detain the suspects pending further investigation.
The body of the deceased was transferred to Mama Lucy Hospital mortuary for further examination.
