On the evening of October 23, 2023, former Nairobi governor Mike Sonko orchestrated the temporary release of Brian Mwenda Njagi, who faced allegations of impersonating a lawyer.
Joined by prominent lawyer Danstan Omari, they recorded a statement alongside Mr. Njagi at 10:12 PM, revealing that they had posted the Sh 200,000 bail set by the judge for Mr. Njagi's case.
"As Kenyans can see, my client, Brian, is out of the prison barriers. He has been paid a cash bail of Sh 200,000 by his excellency (former) Governor Sonko, who believes in the potential and development of the youth. The Law Society of Kenya is in a confrontation with a very young man. Without any valid reason, this young man has been incarcerated for over five days. Criminals, murderers, rapists, defilers, and sodomizers are the ones who should be behind bars. This is a nation that values its youth," began Mr. Omari.
He expressed his happiness that Mike Sonko stood with the youth, hustlers, and those marginalized by individuals with money and power.
"It is a historic day in my legal practice to witness young men rise to success. I will take him home. Thank you, Governor, for what you've done, and thank you, Brian, for upholding the law. We have information that, after their loss today, they plan to re-arrest him next Thursday. We call on the Director of Public Prosecutions to uphold the law because it does not grant the Law Society of Kenya the authority to direct the DPP," Mr. Omari added.
The trio recorded the video in a public setting, with background music audible, and then proceeded to a gathering place to enjoy some "apple juice," as humorously referred to by Mike Sonko.
Mr. Njagi had pleaded not guilty the previous week before Chief Magistrate Lukas Onyina after being charged with identity theft and forgery. He was accused of assuming the identity of a legitimate practicing lawyer with the same name and falsifying certificates to that effect.
"Brian Mwenda Njagi is now at DCI. We will ensure that he faces the full extent of the law. The evidence gathered so far points to multiple cases of forgery and identity theft. Further investigations are ongoing. We are collaborating closely with the DCI team to conduct thorough and comprehensive inquiries. This case will serve as a deterrent to future impostors," stated Mr. Eric Theuri, the President of the Law Society of Kenya, following Mr. Njagi's arrest last week.
