The Public Procurement Administrative Review Board (PPARB) has directed Kenya’s Independent Electoral and Boundaries Commission (IEBC) to amend the tender for the Integrated Elections Management System (IEMS) that will support the 2027 General Election.
The board, acting on a partial review request filed by Galadirel Investment Limited, said the original document contained unclear and insufficiently objective requirements and evaluation criteria, including specifications on hardware ownership, technical standards and the scoring of technical bids.
Identified as tender IEBC/OIT/01/2026-2027, the procurement covers supply, delivery, installation, testing, commissioning, support and maintenance of the IEMS, together with all associated hardware and accessories.
PPARB’s ruling requires the commission to correct, clarify and amend the identified sections, then publish a new compliant tender.
Prospective bidders must be given a minimum period of seven days – the timeframe prescribed by Kenyan procurement law – to consider the revisions and submit their offers.
The board also permitted the IEBC to obtain technical advice from the Public Procurement Regulatory Authority (PPRA) under Section 9(1)(g) of the Public Procurement and Asset Disposal Act.
The decision, which must be forwarded to the PPRA Director‑General for monitoring, stops short of cancelling the tender or redefining the technical specifications of the election management system.
The amendment follows an earlier admission by the IEBC that its tender incorrectly required a performance security of 20 % of the contract value, double the legal ceiling of 10 %.
The commission said it was preparing an addendum to correct that error while maintaining that the overall procurement process remained valid.
PPARB highlighted that the tender is an open international competition for a highly specialised information system, and stressed that any revisions should promote fairness, transparency, competitiveness and equal treatment of bidders, as mandated by Article 227 of the Constitution and the Public Procurement and Asset Disposal Act.
