Advocate Morara Omoke has filed a petition to prevent Chief Justice Martha Koome, or anyone acting under her orders, from swearing in a new Deputy President if Rigathi Gachagua’s impeachment is upheld by the Senate. The case challenges the legitimacy of the impeachment, raising concerns over constitutional violations, lack of public participation, and alleged bribery in the signature collection process by MPs.
Omoke argues that the impeachment motion was hastily introduced and driven by political motivations without meaningful consultation of the public. The petition also claims that some MPs' signatures were forged or obtained under coercion. Additionally, Omoke contends that Gachagua is being unfairly targeted for his regional focus on reforms and defense of Mt. Kenya communities.
Omoke seeks conservatory orders to block any swearing-in of a new Deputy President until the petition is fully heard and determined. He also requested the consolidation of all related petitions and a public hearing on the matter, citing the national significance of Gachagua's impeachment.
